Terms of Service for Managed IT Services Company & Acceptance of Terms
Effective Date: 1/1/2015
These Terms of Use outline the terms and conditions governing your use of our managed IT services. By using our services, you agree to comply with and be bound by these terms. If you do not agree with these terms, please refrain from using our services. By requesting, authorizing, or using any services provided by Tampa PC Consultants, including but not limited to computer repair, managed IT services, cybersecurity, networking, data recovery, hardware sales, software installation, remote support, or on-site services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, as amended from time to time. Your use of our services constitutes your acceptance of these terms.
1. Services:
We provide managed IT services aimed at maintaining and supporting your technology infrastructure. The scope of services, including pricing and deliverables, will be outlined in a separate agreement.
2. User Responsibilities:
You agree to:
Provide accurate and complete information necessary for us to deliver our services effectively.
Comply with all applicable laws and regulations when using our services.
Safeguard any login credentials or access information provided to you.
Cooperate with us to facilitate the delivery of our services, including providing necessary access to your systems and equipment.
3. Payment:
Payment terms will be outlined in the separate agreement. Failure to make payments may result in the suspension or termination of services. All Pre-paid services are non-refundable.
4. Intellectual Property:
We retain all intellectual property rights related to our services, including software, documentation, and any custom solutions developed for you.
5. Confidentiality:
Both parties agree to treat any non-public information shared during the course of providing services as confidential.
6. Limitation of Liability:
We will make reasonable efforts to provide reliable and secure services. However, we are not liable for any direct, indirect, incidental, consequential, or special damages arising from the use or inability to use our services.
7. Indemnification:
You agree to indemnify and hold us harmless from any claims, losses, liabilities, and expenses arising from your use of our services or violation of these terms.
8. Termination:
Either party may terminate the services for cause if the other party breaches these terms. Termination will not relieve you of any payment obligations accrued prior to termination.
9. Governing Law:
These terms are governed by the laws of Florida, without regard to its conflict of law principles.
10. Changes to the Terms:
We reserve the right to update these terms at any time. Changes will be effective upon posting on our website or notifying you directly.
11. Entire Agreement:
These terms constitute the entire agreement between you and [Company Name] regarding the use of our services and supersede any prior agreements or understandings.

By using our managed IT services, you acknowledge that you have read, understood, and agreed to these Terms of Service.
13. Equipment Pickup & Abandoned Property
Customers are responsible for promptly retrieving their equipment after being notified that service has been completed or that no further work can be performed.
If equipment, computers, laptops, servers, mobile devices, storage media, or any other hardware remains unclaimed for 30 calendar days after Tampa PC Consultants first notifies the customer that the equipment is ready for pickup (or that service has concluded), and the customer has not responded or made arrangements for pickup or storage, the equipment may be considered abandoned to the extent permitted by applicable law.
Tampa PC Consultants may attempt to contact the customer using the phone number, email address, or mailing address provided during the service request. It is the customer’s responsibility to keep their contact information current.
After the 30-day period has expired, Tampa PC Consultants reserves the right, to the extent permitted by applicable law, to charge reasonable storage fees, recycle, dispose of, sell, donate, or otherwise handle the abandoned equipment without further liability or obligation to the customer. Any proceeds may be applied toward unpaid invoices, storage charges, repair costs, or other amounts owed.
Tampa PC Consultants is not responsible for any loss of data or personal information remaining on abandoned equipment. Customers are solely responsible for maintaining backups of their data before submitting equipment for service.
14. Tampa PC Consultants reserves the right to assess reasonable storage fees on equipment that remains in our possession after notification of completed service. Any applicable storage fees may be added to the customer’s outstanding balance and must be paid before equipment is released.
15. Right to Refuse Service
Tampa PC Consultants reserves the right to refuse or discontinue service at its sole discretion, subject to applicable law, including but not limited to circumstances involving abusive behavior, unsafe working conditions, non-payment, fraudulent activity, or requests that violate applicable laws or regulations.
